Privacy vs. National Security Essay
The scope and nature of the problem is that after September 11, 2001 the government has enhanced its surveillance procedure to a frightening level. With one policy, ââ¬Å"The USA Patriot Act-2001,â⬠the US government has effectively turned the United States of America into a police state. This policy gives the government run agencies the right to spy on its citizens. Agents can gather information by physically watching, or by other covert means such as wire taps. It is no longer a specific phone line but on individuals. It allows service providers to disclose information and protects them from court action when the do. It permits a delay in warrant notification, giving agents the ability to search before they have a warrant in hand. This policy gives the government the right to accuse, intimidate, and imprison its citizens of terrorism, and ignore the Bill of Rights. The Bill of Rights was created to protect the people from various injustices that the government could commit. The amendments that are affected the most are the 1st, 4th, and the 6th. (Asian Tribune,[Hallstavik],June 5,2012, US Patriot Act has denied Americans their freedom) Amendment I: Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press, or the right of people peaceably to assemble, and petition the government for a redress of grievances.(Hamilton, A.,1775, The Bill of Rights) The Patriot Act gives the government the freedom to monitor religious and political institutions without just cause. The government also now has the authority to prosecute any type of record keeper if they reveal that the government has subpoenaed information from them for a terrorism Investigation. (Asian Tribune, [Hallstavik], June 5, 2012, US Patriot Act has denied Americans their freedom) Amendment IV: The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause. Supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. (Hamilton, A., 1775, Bill of Rights) The Patriot Act of course now gives the US government to do just that. They may search and seize a citizenââ¬â¢s property without probable cause regardless of it pertinence to a terror investigation. (Asian Tribune [Hallstavik], June 5, 2012, US Patriot Act has denied Americans their freedom) Amendment VI: In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which d istrict shall have been previously ascertained by law, and to be informed at the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense. (Hamilton, A., 1775, Bill of Rights) The Patriot Act has given the government the power to jail US citizens indefinitely without charge or trial, or even to confront the witnesses against them. Once labeled an ââ¬Å"unlawful combatantâ⬠, the accused can and have been held without communication and denied their right to an attorney. When they are permitted the attorneys and housed in a federal prison, they lose the right to attorney/client privilege. The government now has the right to monitor those communications as well. (Asian Tribune [Hallstavik], June 5, 2012, US Patriot Act has denied Americans their freedom) Though there is one good point to the policy, which is: providing for victims of terrorism, public officers and their families. That is but a single clause in the policy that is for the people, the rest gives the government an overwhelming and undeniable control over the ââ¬Å"American citizens rights and the means to continue and expand its control. Reading numerous articles and summaries of the act it is obvious that the American people should be concerned about just how much power the government is gaining, then giving to the military and agencies such as the Federal Bureau of Investigation (FBI), and Central Intelligence Agency (CIA). The power the agencies have, have been a problem in the past as well. In 1975 the senate had selected a committee to oversee these agencies, primarily the FBI, which had been declared a vigilante organization. Focusing on suppressing groups from exercising their First Amendment rights, the FBI went with the theory that preventing the growth of a group would protect national security. The Patriot Act has basically nullified this committee, while granting the government agencies free reign. (Hentoff,N., December 17, 2001, Homeland Defense of the Constitution) Since the bombing in Oklahoma City on April 15, 1995, the government has attempted to do more to prevent another terrorist attack, and it began with the Antiterrorism and Effective Death Penalty Act of 1996. This in simplest terms takes the right of Habeus away from those convicted of terrorism. To file for Habeas Corpus is to petition for an early release and can be done repeatedly. The attack on the Twin Towers on 9-11 unfortunately has shaken the countries defense structure to itââ¬â¢s very core allowing for some rather irrational and extreme actions to be taken. Such as the US Patriot Act, this act was adopted as a sunset policy (meaning it would expire in four years). This was to enable the individual agencies to adapt and ascertain the effectiveness (Fritscher, L., November. 5, 2007.USA Patriot Act: Pros and Cons). This policy, which to congress an unprecedented 43 days to sign into law, was essentially formed to treamline communications between the agencies to provide easier means of investigation and surveillance. Other policies that are not so widely impacted have been passed as well. Policies such as, the National Defense Authorization Act, supplying these agencies the funding to continue. Preliminary research indicates a growing concern the government, and the agencies there of, are gaining too much power, and the aggressive use of this power is progressively eroding the individual American citizensââ¬â¢ privacy and civil liberties. How do the people know that the information gathered by various agencies is not being abused? What assurances can the government give that they wonââ¬â¢t be? The security of a nation is a major concern to all Americans, but should there be a limit to what the government can do in the name of National Security. Problems with abuse of privilege have been an issue in the past as well. During the cold war the foreign Intelligence Act was introduced and passed requiring agents to obtain a warrant from a judge before they could intercept private conversations. To gain a warrant government lawyers had to have proof that an individual was a threat. In 2008 this act was revised enabling the procedures to be overlooked. In fact, the law was bypassed by the Bush administration in 2001 after the terrorist attack on 9-11. Individuals and organizations alike are attempting to sue the government in regards to the ongoing surveillance program. The ACLU (American Civil Liberties Union), stated that the, ââ¬Å"people cannot sue unless they can show their calls were monitored.) Alas, the government will not reveal whose messages were intercepted, therefore no proof (Scalliger,C. May 21, 2012). Obviously, the odds are greatly against those who oppose the current policies. Individuals have come forward to attempt to inform the public of the actions of the government but to no avail. In 2007 an ex NSA employee reported that a program, codenamed Stellar Wind was already underway. Gathering information on millions of American citizens, the NSA gained access to more than 2.8 trillion billing records of domestic and international calls. All, without a warrant. At a later date Verizon joined the program multiplying the call rate five times over. Not only is the NSA and other agencies compiling dossiers on US citizens in these massive data bases, they also currently have the ability to eavesdrop in real-time. US citizens overseas are routinely intercepted when calling home to the states. No reason or warrant required (Hentoff, N., October 6, 2011). The reality is that unwarranted wiretaps are only the beginning. Other forms of spying on the average citizen are already being used. The Fourth Amendment was written to protect our rights to privacy, yet our own government officials a sidestepping these laws. Though the word privacy never actually appears in the Constitution, it would be difficult to say the fact that something of the meaning of the word has long been established in legal traditions. The American Heritage Dictionary defines the word private as secluded from sight, presence or intrusion of others, to be confined to one person; personal (Mitrano, T., May 2012). A primary responsibility of the United States government is to protect the citizens and its resources against the threat of terrorism, and Americans appreciate the security they have, and at times have sacrificed liberties to protect it (Walker, B. and Rsachke, G., nd). But, in spite of the measures taken to protect its people the government is also harming their basic fundamental rights that this country has always been known for. So are the citizens of the United States to give up democracy for a governmental dictatorship for the sake of this safety. Whatââ¬â¢s in store for the next generation? As imagined, this was done in the interest of certainty in law but it did have the potential of leading to unfairness for a party to whom the benefit was provided, such as that witnessed in Dunlop and Shanklin Pier v Detel Products3. This is where the Law Commission came in with its reforms in 1996. The resulting Contract (Rights of Third Parties) Act 1999 brought into force that report of the Law Commission (1996) which allows third parties to enforce the contract and be able to sue for breaches subject to a few conditions. Needless to say, this brought forth a welcome wave of statutory protection for third parties which previously were entitled to benefits under that contract but still could not enforce it due to lack of consideration. Section 1 of the Contract (Rights of Third Parties) Act 1999 provides that a third party may be able to enfo rce the terms of the contract if ââ¬Å"the contract expressly provides that he mayâ⬠(s.1(1)(a)) and ââ¬Å"the term purports to confer a benefit on himâ⬠(s. 1(1)(b)) (except where on proper construction à of the contract it appears that the parties did not intend the term to be enforceable by the third party (s.1(2)). Thus if A agrees to pay C $100 on the performance of an obligation by B, C can enforce that payment if A fails to pay in breach. This was not the case earlier, as seen in Beswick v Beswick4 where the nephew made a contract with his uncle which involved payment of weekly maintenance to the aunt. The House of Lords held that Mrs. Beswick could not enforce the contract since she was not privy to it. In light of the Contract (Rights of Third Parties) Act 1999 today, it is clear that the case would have been decided differently. The third party may also rely on exclusion clauses in order to protect its interest. However, simply conferring a benefit to the thi rd party may not be enough to grant him a right to sue. Where there is doubt as to whether the parties designed the agreement to avoid conferring a right to sue on the third party, s.1(2) applies and the courts will, on a proper construction of the contract, seek to determine the actual intention of the parties. This presents certain problems if the contract does not expressly state the intention of the parties. In Nisshin Shipping Co Ltd v Cleaves & Co Ltd [2003]5, the burden of proof to counter a right granted to a third party to sue under s.1(2) was placed on the party that alleges that such a right has been wrongfully applied (as per Colman J). Thus, in a neutral contract, where there is no language barring the third party to sue, it would usually follow that the statute often grants a right to sue to the third party. This safeguards the third party a little too broadly, and it has been applied differently where the chain of sub-contracts is long. In cases where the contract con sist of sub-contracts that purport to confer a benefit to a third party, it is more likely for courts to construe that parties privy to a sub-contract lower down the chain did not intend to enable the third party benefitting under that contract to sue up the hierarchy the original contractor (see Junior Book v. Veitchi & Co Ltd [1983]6. Of course, it must be noted that the Act does not allow the right to a third party in all cases and the parties may explicitly bar him to sue on it. Gender stereotypes A 1952 magazine feature stereotyping women drivers. Gender stereotypes are widely held beliefs about the characteristics and behavior of women and men. Gender stereotypes are not only descriptive, but also prescriptive beliefs about how men and women should be and behave. Members of either sex who deviate from prescriptive gender stereotypes are punished; assertive women, for example, are called bitches whereas men who lack physical strength are seen as wimps. Empirical studies have found widely shared cultural beliefs that men are more socially valued and more competent than women at most things, as well as specific assumptions that men are better at some particular tasks (e. g. , mechanical tasks) while women are better at others (e. g. , nurturing tasks). Although hag and fairy both have non-sexist interpretations, when they are used in the context of a genderââ¬âspecific pejorative term these words become representations of sexist attitudes. The relationship between rape and misogyny Research into the factors which motivate perpetrators ofà rapeà against a specific gender, for example, women, frequently reveals patterns of hatred of said gender and pleasure in inflicting psychological and/or physical trauma, rather than sexual interest. Researchers have argued that rape is not the result of pathological individuals, but rather systems of male dominance, cultural practices and beliefs that objectify and degrade women. Mary Odem, Jody Clay-Warner and Susan Brownwiller consider sexist attitudes to be propagated by a series of myths about rape and rapists. They state that contrary to those myths, rapists often plan a rape before they choose a victim and that acquaintance rapeà is the most common form of rape rather than assault by a stranger. Odem also states that these rape myths propagate sexist attitudes about men by perpetuating the thought that men cannot control their sexuality. Occupational sexism Occupational sexism refers to anyà discriminatoryà practices, statements, actions, etc. based on a personsà sexà that are present or occur in a place ofà employment. One form of occupational sexism isà wage discrimination. In 2008, theà Organization for Economic Cooperation and Developmentà (OECD) found that while female employment rates have expanded considerably and the gender employment and wage gaps have narrowed virtually everywhere, on average, women still have 20% less of a chance to have a job and are paid 17% less than men. Moreover, the report stated: [In] many countries, labor marketà discriminationà ââ¬â i. e. the unequal treatment of equally productive individuals only because they belong to a specific group ââ¬â is still a crucial factor inflating disparities in employment and the quality of job opportunities [ ] Evidence presented in this edition of theà Employment Outlookà suggests that about 8% of the variation in gender employment gaps and 30% of the variation in gender wage gaps across OECD countries can be explained by discriminatory practices in the labour market. The report also found that despite the fact that almost all OECD countries, including the U. S. have established anti-discrimination laws, these laws are difficult to enforce. Gender stereotypes Gender rolesà (or sex roles) are attitudes and activities that a society links to each sex. A culture that defines males as ambitious and competitive encourages them to seek out positions of leadership and play team sports. To the extent that females are defined as deferential and emotional, they are expected to be supportive helpers and quick to show their feelings. According to theà OECD, womens labor market behavior is influenced by learned cultural and social values that may be thought to discriminate against women (and sometimes against men) by stereotyping certain work and life styles as male or female. Further, the OECD argues that womens educational choices may be dictated, at least in part, by their expectations that [certain] types of employment opportunities are not available to them, as well as by gender stereotypes that are prevalent in society. There is a long record of women being excluded from participation in many professions. Often, women have gained entry into a previously male profession only to be faced with additional obstacles. Elizabeth Blackwell, the first woman to receive an M. D. in theà United Statesà andà Myra Bradwell, the first female lawyer in the state ofà Illinois, illustrate the prevalence of women being excluded from certain professions and the changing culture. In addition, women frequently earn significantly lower wages than their male counterparts who perform the same job. In the U. S. , for example, women earn an average of 23. 5% less than men. In 1833, women working in factories earned only one-quarter of mens wages, and in 2007, womens median annual paychecks reflected only $0. 78 for every $1. 00 earned by men. A study showed women comprised 87% of workers in the child care industry and 86% of the health aide industry. Some experts believe that parents play an important role in the creation of values and perceptions of their children. The fact that many girls are asked to help their mothers do housework, while many boys do technical tasks with their fathers, seems to influence their behavior and can sometimes discourage girls from performing such tasks. Girls will then think that each gender should have a specific role and behavior. A 2009 study found that being overweight harms womens career advancement but presents no barrier for men. Overweightà orà obeseà women were significantly under-represented among company bosses, whereas a significant proportion of male executives were overweight or obese. The author of the study stated that the results suggest that the glass ceiling effect on womens advancement may reflect not only general negative stereotypes about the competencies of women, but also weight bias that results in the application of stricter appearance standards to women. At other times, there are accusations that some traditionally female professions have been or are being eliminated by its roles being subsumed by a male dominated profession. In recent decades more women have entered the United States workforce. After WWII (from about 1947), about 30 percent of women were employed outside the home; today, at the start of the 21st century, the figure is well over 50 percent. (Some estimates approach 75 percent if ââ¬Å"part-timeâ⬠jobs are included. Yet women are far from treated equally on the job. Typically, they hold lower-paying, lower-status jobs than men. In fact, women may account for only 25 percent of the upper-level managers in large corporations. And although half of the employees in the largest, most prestigious firms around the United States may be women, perhaps as few as 5 percent or less actually hold senior positions. In general, women are under-represented in the higher-status, higher-paying occupations, such as university teaching, law, engineering, and medicine. In contrast, women are over-represented in the lower-paying occupations, such as public-school teaching, nursing, and secretarial work. In stereotypical female jobs, referred to asà womens ghettos, women are subordinate to the positions of men. For example, executives supervise secretaries who are likely to be women, and lawyers supervise paralegals, who are also likely to be women. Women in the same jobs as men usually earn less, even though these women may have the same or better training, education, and skills. As a general statistic, women make only 60 percent or less than men in comparable positions. Why this disparity? Sociologists speculate that, in some cases, the fact that women often must take time off to have and raise children interrupts their career path. As much as Americans may hate to admit it, women in the United States still bear the primary responsibilities of child-rearing. Conflicting demands may partly explain why married women with children are more likely to leave their jobs than are childless and single women. Arizona needs a law requiring adult bicycle riders to wear a helmet! Have you ever known somebody who was injured in a car accident? What do you think his attitude about seat belts was after they saved his life? If you knew that a seat belt would save your life, you would buckle up! It took years of legislation and public awareness campaigns to make seat belt use mandatory. Now a new topic regarding public safety is coming to light: people are dying or becoming seriously injured in seemingly minor accidents on bicycles when the rider's head strikes the concrete. When the head is unprotected "the brain continues to move in a forward motion while the skull stops moving" (Macyko1), causing trauma. What is needed is a way to protect the brain "by absorbing the energy from the impact, buying extra time for the brain to slow down" (Macyko1). Bicycle riders need to wear helmets to protect their brains from injury, yet unfortunately the public is simply not aware of this need and many people will continue to die or be seriously injure d unless something is done. Bicycle helmets save lives and should be required by Arizona State law for riders of all ages. Opponents feel that bicycle helmet laws are too strict and are misdirected. Principally, they feel that helmet laws do not prevent accidents and point out the fact that "motor vehicles are involved in 90-92% of bicyclist deaths" (BHSI/Compendium 4). Creating awareness among drivers by lowering their speeds would create a safer cycling environment. Furthermore, opponents of helmet laws believe that "requiring motorists to wear helmets will save more lives" (Convissor 1) since statistics show the likelihood of fatality while riding in passenger cars is nearly double that of bicycling (Bicycle 15). They are also concerned for the overall popularity of their sport when helmet laws go into effect. After helmet laws went into effect in Australia, "surveys in Sydney found the helmet law reduced cycling by 38%" (Convissor, 1). Another issue is the argument that helmets are inconvenient and uncomfortable. The opponents of helmet laws seem to have a good argument. Helmet use cannot prevent an accident and Department of Transportation statistics indicate seventy five percent of bicycle related deaths are in collisions with motor vehicles (American Academy of Orthopedic Surgeons 2), which implies the real problem is with automobile drivers causing accidents with bikes.

The Portuguese arrived in 1543 when Japan was a war torn country divided by different warlords. Along with trade, the Portuguese brought Jesuit missionaries who successfully proselytized Christianity if not to a large-scale, which would nonetheless be significant to future Japanese rulers. During their time in Japan, the Portuguese would see the rise of the three great shogunal unifiers. The first of these was Oda Nobunaga, who actually supported Christian efforts in order to counter 2 the militant Buddhist domains that resisted his rule. However, the thing I never think of is where does the food Iââ¬â¢m eating come from?Iââ¬â¢m going to analyze one meal that I have eaten today, a cheeseburger and potato salad. When my family makes potato salad, it normally consists of potatoes, onions, and bacon. Potatoes are the leading vegetable crop in the United States, contributing about 15% of farm sales (Jerardo, 2012). Over 50% of potato sales fare to processor for French fries, chips and other potato products (Jerardo, 2012) . Western states such as Idaho, Washington, and Colorado produce two-thirds of fall potatoes with Idaho and Washington accounting for over half of the United States total (Jerardo, 2012).Potatoes are usually grouped within two categories, fresh and processing. Processing potatoes then get broken down into, frozen (French fries), chips, dehydrated or canned (Jerardo, 2012). We always use the fresh potatoes when making the salad. United States farmers plant approximately 125,000 acres of onions each year and produce about 6. 2 billion pounds a year (National Onion Association, 2011). The top 3 producing states of onions are Washington (22,828 acres), Idaho-Eastern Oregon (21,000 acres) and California (17,850 acres) (National Onion Association, 2011).Approximately 170 countries grow onions for their own domestic use, however many are involved in international trade (National Onion Association, 2011). The top leading countries for onion production are China, India, United States, Turkey and Pakistan; they count for 8% of global onion production (National Onion Association, 2011). After researching, I believe that the only way to get onions is having them fresh in the produce section of your grocery store. Bacon is most likely my most beloved part of the potato salad. Who doesnââ¬â¢t love bacon, right?The two main methods of curing bacon are pumping and dry curing. In return if people use their product for a decant amount of money and they are satisfied, they are going to tell someone about it then they will possibly gain another customer. One of this disadvantages of having a market like this is that because there are so many different sources for people to use, companies can f orget the consumer.Some companies maybe think that because they are selling their products for less money, that they can cut corners and not use the best supplies to make their products. This might tempt the consumer to go to another company and pay a little more but they will have a better product coming out of it. Although trading and selling goods with other countries is a good thing, staying local will cut down on pollution in the air. These days it is getting tough with the prices of everything rising so staying locally will also benefit the farmers in the area.Before this assignment I never really thought of the impact that my choices of where I bought my food can make. Even if just one more a person a day chose to buy something locally, I believe that they can make a huge difference globally.
